[実例で学ぶジャンクメール] 詐欺メールの見分け方 その１
最近はメールでの詐欺が増えています。
今回は実際に届いたメールを元にどうやって見分けるのかをみていきます。
（アドレスなどは改変しています。）
From: "aaaa@yahoo.co.jp"
まず、業者のメールに関してですがYahoo!やHotmailなどのフリーメールを介したものはまず詐欺と考えていいでしょう。 また、アドレスが一定でないのは怪しいです。
件名：お客様コード：JL-********
意味がわからないコードなどが書かれているものは要注意。
弊社は信用調査会社様からの依頼に基づいて利用料金支払遅延者のデーターを
一括管理している株式会社日本データー管理機構と申します。
非常に怪しいですね。 信用調査会社様、とお茶を濁しています。 仮にも依頼を受けているわけですから、まともであればその会社名は明かすはずです。
また、担当者の名前も書いていません。
ちなみにこの株式会社日本データー管理機構というのは調べて見た限りでは存在しないようです。 株式会社でないものが株式会社と名乗るのは商法１７条に違反しています。
この度は貴殿が使用されたプロバイダー及び電話回線から接続された
有料サイト利用について運営業者より利用料金支払遅延に関して
ブラックリスト掲載要請を受けました。
まず、一つ言えることはよほど特殊な契約をしていない限り、プロバイダー（接続業者）から請求がくるわけがありません。 また、本当にそうである場合は場合は直接プロバイダーからまず連絡があるはずですし急にブラックリストに掲載するなどこんなばかな話はありません。
これまで貴殿の利用料につきましてはコンテンツ事業者方に未だご入金がなく
また、誠意ある回答も頂いておりません。
「コンテンツ事業者」とはどこの誰かが表記されておらず、これも非常に曖昧です。
よって「電子消費者契約民法特例法」上、以上の理由から信用調査会社を経由して弊社に貴殿の個人情報を利用料金支払遅延者リスト（ブラックリスト）掲載要請が弊社に届きました。
「電子消費者契約民法特例法」なんて法律はありません。 メールに法律名が書いてある場合にはまずその趣旨が何を示しているのかを検索してみましょう。 もし法律自体が存在しないのであればこれは完全な詐欺です。
貴殿の情報に関しましては、既にメールアドレス（フリーメール含む）及びＩＰから、
プロバイダー・ＩＳＰ業者から情報開示を受け、貴殿の住所、氏名、勤務先等の情報は判明しております。
利用料金支払遅延者リスト（ブラックリスト）に掲載されますと、各種融資・クレジット契約・携帯電話の購入及び機種交換他、貴殿の日常生活における信用情報に今後大きな支障が発生する可能性があります。
つきましてはコンテンツ事業者及び、債権回収業者並びに顧問法律事務所とも協議の結果、次の通り最終和解案を決定いたしましたので通知いたします。
入金確認後、延滞情報リストから貴殿に関する全データーを削除し、株式会社日本データー管理機構保管の債権譲渡証明書、内容証明等の書類一切を、抹消させて頂きます。
ご入金して頂けず、このまま放置されますと、最終的に各地域の事務所から数名の集金担当員がご自宅及び、勤務先まで訪問をさせて頂きます。
上記は恐喝（刑法第２４９条）に当たります。 これはヤクザが言うようなことですね。 言っていることは「はよ金返さんと組の若いもんよこすぞ」と言っているのと同じこと。 特にこの文のミソは、「勤務先まで訪問」というところ、これは実行すると名誉棄損につながる可能性があります。 もちろん恐喝に加え、場合によっては出資法にも違反する可能性もあります。
なお、余談ですが私はアメリカ在住なのですがこれを実際に行うのには国際裁判を起こす必要があります。 また、現在のアメリカの法律ではＩＳＰはそんな簡単には個人情報を漏らすことができません。 ＲＩＡＡ（アメリカの音楽事業者団体）が対象者の氏名の開示すら受けずに訴訟を起こしているのは記憶に新しいところです。
また、その際に掛かります費用・調査費用・交通費等の雑費は別途回収手数料も合わせてご請求させていただきます。
また、場合によっては裁判所を通じた法的手段にて強制執行による給料差し押さえ等を含めあらゆる手段で対応させていただく事になります。
このように正当な理由もなしに強制執行をちらつかせるのも恐喝になります。

上記はこっけいなぐらいわかりやすい例なのですが注意深くみると多くの詐欺メールは同じような要素を含んでいます。
本当に心配な場合は（心当たりがある場合など）弁護士などに相談されることをお勧めしますが、多くの場合はこのような詐欺となります。
なお、間違えても確認もなしに入金などしないようにしてください。
